{"id":337,"date":"2009-12-02T13:48:19","date_gmt":"2009-12-02T12:48:19","guid":{"rendered":"http:\/\/www.hazards.org\/blacklistblog\/?p=337"},"modified":"2009-12-03T11:30:15","modified_gmt":"2009-12-03T10:30:15","slug":"government-announces-blacklisting-plans","status":"publish","type":"post","link":"https:\/\/www.hazards.org\/blacklistblog\/2009\/12\/02\/government-announces-blacklisting-plans\/","title":{"rendered":"Government announces blacklisting plans"},"content":{"rendered":"<p><a href=\"null\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"http:\/\/photos-g.ak.fbcdn.net\/hphotos-ak-snc3\/hs007.snc3\/11438_224283318031_646083031_4277146_231310_n.jpg\" alt=\"\" width=\"604\" height=\"453\" \/><\/a><\/p>\n<p>It will be unlawful for trade union members to be denied employment through blacklists under plans outlined by <a href=\"http:\/\/nds.coi.gov.uk\/clientmicrosite\/content\/Detail.aspx?ReleaseID=409194&amp;NewsAreaID=2&amp;ClientID=431\">employment relations minister Lord Young<\/a>.<\/p>\n<p>He said the new law will ban employers from blacklisting workers for their trade union membership or activities.<\/p>\n<p>Commenting on the publication of the <a href=\"http:\/\/www.berr.gov.uk\/files\/file53734.pdf\">government\u2019s response<\/a> to a public consultation on the subject held over the summer, Lord Young said: \u201cBlacklisting someone because they are a member of a trade union is totally unacceptable. There is already legal protection against the misuse of people\u2019s personal details. We will now strengthen the law by introducing new regulations to outlaw the compilation, dissemination and use of blacklists.\u201d<\/p>\n<p>The minister added: \u201cThe government is determined to stamp out this despicable practice and our legislative proposals are a proportionate and robust response.\u201d<\/p>\n<p>The regulations will:<br \/>\n\u2022 make it unlawful for organisations to refuse employment or sack individuals as a result of appearing on a blacklist;<br \/>\n\u2022 make it unlawful for employment agencies to refuse to provide a service on the basis of appearing on a blacklist; and<br \/>\n\u2022 enable individuals or unions to pursue compensation or solicit action against those who compile, distribute or use blacklists.\u00a0<\/p>\n<p>The regulations will be tabled for consideration by parliament as soon as possible, the minister said. The government\u2019s claim that the new regulations \u201cneed to be debated and approved by each House before they can be implemented,\u201d runs counter to earlier advice that business secretary could go ahead and introduce the necessary amendments to the Employment Relations Act 1999 without further debated.<\/p>\n<p>The government said provided parliament gives its approval, the regulations could be brought into effect early next year.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>It will be unlawful for trade union members to be denied employment through blacklists under plans outlined by employment relations minister Lord Young.
