{"id":209,"date":"2009-09-14T15:07:12","date_gmt":"2009-09-14T14:07:12","guid":{"rendered":"http:\/\/www.hazards.org\/blacklistblog\/?p=209"},"modified":"2009-09-16T11:23:27","modified_gmt":"2009-09-16T10:23:27","slug":"britain-judge-proposes-blacklist-test-cases","status":"publish","type":"post","link":"https:\/\/www.hazards.org\/blacklistblog\/2009\/09\/14\/britain-judge-proposes-blacklist-test-cases\/","title":{"rendered":"Judge proposes blacklist test cases"},"content":{"rendered":"<p>Workers who are taking legal action against employers on the grounds that they were refused employment after being blacklisted may have their fate decided by three test cases in north-west England.<\/p>\n<p>A number of trade union reps who believe they were victimised for their health and safety activities have already initiated tribunal cases.<\/p>\n<p>The test case proposal has been put forward by Mr Justice Brain, who is presiding over an employment tribunal in Manchester, as a way of resolving other cases quickly. It is not known how many workers are suing, but about 3,200 were included on the list run by a private detective called Ian Kerr, and used by many of the UK\u2019s largest contractors.<\/p>\n<p>A report in trade journal\u00a0<a href=\"http:\/\/www.building.co.uk\/story.asp?sectioncode=29&amp;storycode=3148374&amp;c=1#ixzz0Qmr23GN2\">Building<\/a>\u00a0says letters have been sent to employers and blacklisted workers in the area to ask whether they would be amenable to consolidating the cases in order to achieve a speedier resolution.<\/p>\n<p>The cases would be chosen by lawyers representing workers and contractors, and would set a precedent that would allow the speedy resolution of other cases.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Workers who are taking legal action against employers on the grounds that they were refused employment after being blacklisted may have their fate decided by three test cases in north-west England.
